Responsible Vendor Alcohol Training - Dram Shop Law Basics

It is the general consensus that restaurants, bars, and other establishments that sell or serve alcoholic beverages bear a responsibility to provide the alcohol in such a way that it is safe for both the patrons or to the public. This has led to the creation of many rules, regulations, and guidelines which have been set forth through local, state, and national governments to which these establishments must adhere in order to maintain this important responsibility. Unfortunately, as is often the case, a variety of circumstances can interfere with compliance with these rules. However, in this case, the consequences can be deadly. Anytime a bar or restaurant fails to follow the responsible vendor laws for providing alcohol, it can lead to many not only drunk driving accidents resulting in personal injury or death, but also alcohol poisoning or crime. In many states, including Florida, this has led to the establishment and enforcement of what have become known as dram shop laws, which is one of the most important lessons learned in responsible vendor alcohol training.
Responsible Vendor Alcohol Training - Intro to Dram Shop Laws
According to the Internet legal resource Legal Match, €€¦a dram shop law or act imposes liability on drinking establishments such as bars and taverns (€dram shops€) who serve alcohol to patrons who are already visibly or obviously intoxicated. Drinking establishments may have to pay damages to third parties who are injured by the people whom they sold alcohol to.€ Vendors and servers who may be tempted to serve that last drink to an obviously intoxicated individual in a quest for a big tip or may want to give that drink to the owner's 16 year old nephew because €he looks old enough€ or €it won't hurt anything€ need to read and reread this definition as many times as it takes for it to sink in. In the event of a tragedy, not only will the server lose his or her job (and risk litigation), the establishment itself could also be liable for damages, which can reach an astoundingly high rate depending upon the type of incident. There are currently only eight states without dram shop laws, and public service organizations such as Mothers Against Drunk Driving (MADD) are lobbying very hard to get them passed in these areas. Part of the curriculum with responsible vendor alcohol training is learning to spot the signs of intoxication and how to pick out a fake ID and/or refuse service.
