Each year thousands of immigration petitions are filed in the United States.
With the number of petitions received it is no wonder that the process for applying for a visa is long and tedious.
After a long waiting period and the effort of submitting all the required documents, one of the worst things to receive would be a Request for Evidence (RFE) or Notice of Intent to Deny (NOID).
In both cases the applicant will need to reply with what is being asked for.
More often than not the time frame given for you to respond may be very short.
What is a RFE/NOID? As mentioned earlier RFE stands for Request for Evidence.
When the U.

Government sends you this kind of notice it means that they need some additional evidence from you.
It may not always necessarily mean that you will immediately be denied.
Your documents may be incomplete or lacking; in which case you will need to provide all the missing or necessary paperwork that is being requested.
On the other hand a NOID Notice of Intent to Deny or NOID may mean that sufficient evidence was provided but it may not be able to establish eligibility for the petition being sought.
What Should I Do? The most important thing to do once you receive this kind of notice is to respond to the notice within the given time frame.
Typically, for cases where additional of evidence from the applicant or petitioner is asked, thirty calendar days are given.
For those who are applying for a change in status the same amount of time is given.
Forty two days is given for those who have evidence available in the United States regardless of the type of form.
Lastly, for those with evidence outside of the U.
S.
eighty four days are given.
Should I Do It Myself? It is possible to respond to a RFE/NOID on your own.
However, one down side to this may be that you are not familiar with the process.
Also, since time is a crucial element in these cases, you may not have the time you need to respond to this notice properly.
Keep in mind that a failure to respond to a RFE/NOID will result in the denial of your petition.
Providing the wrong documents/evidence will likewise result in a denied petition.
