Are you upset about all the collection calls that you have been receiving? Is it a constant embarrassment to you? If yes, then you should do something about it.
Here are some points which any consumer should be aware of.
  1. A customer has certain rights which he should be aware of.
    Firstly the customer does not have to promise to pay to the collector.
    And it is always advised against providing the collector with any bank account related details.
    Also it is not permissible for a debt collector to divulge any information to a third party or to threaten the customer.
    There are certain rules regarding the call timings.
    Any call before 8:00 am or after 9:00 pm is not permissible.
    Also any kind of physical or verbal abuse can be reported.
  2. A customer should take full detail of any caller claiming to be from a debt collection agency.
    You must write down the name, company which they are representing and the company's mailing address and phone number.
    A note of every call should be maintained by the debtor.
    In case they decline to give you this information then you should not entertain their calls.
    Once you do have this information you can write a cease and desist letter to the company through a certified mail and must request a return receipt.
    Once the company receives a cease and desist letter from you they are bound by law not to make any more collection calls over the telephone as per the Fair debt and collection practice law.
  3. Once the letter has been received by the company it is possible that they might turn your account back to a regular account and hence open a way for negotiations or if the amount is high it is possible for them to file a law suit.
