Workman's Compensation Benefits
- The expenses incurred as a result of treatment for an injury incurred at work are covered by workman's compensation. Such expenses include visits to doctors or hospitals, medication and x-rays.
- Payment is provided to workers who, as a result of the injury incurred, are unable to work on either a temporary or permanent basis. In the event of incapacitation, a lump sum payment is generally issued.
- If an employee is incapable of ever resuming his previous occupation but can perform other duties, training for another position is provided. However, individuals may be able to return to their former positions after completing physical therapy.
- Injuries that occur as a result of the employee's own reckless behavior or willful misconduct may preclude that employee from receiving benefits. For example, if intoxication or rough-housing at work causes the employee to become injured, the employer may not be at fault.
- The Department of Labor handles workers compensation cases for employees of the federal government. Specific benefits provided by workers compensation law varies from state to state for non-federal employees.
