- 1). Talk to your spouse and be sure that this is really what you want to do with your relationship. Don't make the decision to separate on emotions alone.
- 2). Make sure that you meet the residency requirements for the state in order to be considered for a separate maintenance agreement. In Georgia, you can actually reside in the same household as your spouse.
- 3). File a petition for the separate maintenance. If you wish to do the filing yourself, you can find the forms on the State of Georgia website or any other legal document website. If the forms seem too complicated, you can also have them completed by a lawyer.
- 4). Be sure that you cover all issues to be addressed in the petition, including provisions for child support and visitation, and debt liability.
- 5). Serve your spouse with the petition. Serving your spouse means that you are officially presenting them with the summons from the court and letting them know that the matter has been scheduled to be presented to the court. The only time that you will not have to serve your spouse is if the filing is joint.
