A debtor should not be disturbed before eight in the morning and after nine in the night.

It is important for the debtor and the debt collector to know the clauses of Fair Debt Control Practices Act properly. First and foremost rule is that no credit card debt collection agency can practice any unfair or deceptive ways to collect money from the debtors. This becomes a punishable offence. It should be well practiced that personal information should never be divulged to any person who is calling for collection. Proper cross-check should be made and then only information should be given out. The person calling should properly identify himself and behave transparently. A debtor should not be called more than once in a day. Monetary related information should not be done in postcards and should be dealt as a confidential document. No sign or other language should be used for the collection process through letters. The regular protocol should be followed and uniformity should be maintained.
Some dos and don'ts for the debt collecting agencies
Credit card debt collectors must keep in mind that the privacy of the debtors is very important and it should not be intervened and disturbed. Also proper business timings should be followed. Below are some points that will focus on some dos and don'ts for the collection agencies:
- Early morning and late night is not the correct time to call a debtor and they should never be disturbed
- If a consumer is being helped by a legal counselor then he should not be contacted by a collection agency.
- Debt collecting agencies should never contact a debtor at his work place. Also it will breach the conduct of confidentiality
- Debt collectors should avoid using profanities and abusive language
- Contact details and transaction details should be never told to anyone other than the consumer. Even it should not be told to his family members.
- Information that is posted to the consumer should be done in enclosed envelope and never on a postcard.
- All queries of the customer should be answered promptly and never stop them from communication.
